Course Description:
The Diploma in Shariah provides a deep understanding of how rulings are derived from Quran and Sunnah. It enables a student to understand the Islamic legislation from the point of view of a scholar. This course revolves around the study of Fiqh and its sciences.
Shariah literally means a well-worn path to a water source, and Islamically, it is a term that is used to describe Islam as a complete way of life. Water is essential to human life and the religion of Islam is essential to complete spiritual wellbeing. Thus, Shariah is a set of laws that provide a clear and straight path to fulfilment in this life and success in the Hereafter.
The Shariah is made up of commandments, rules and regulations that are designed by God to protect and benefit all of humankind. It is true that the Shariah does encompass a penal code and system of law but that is only one aspect of it. It also provides the framework for a functioning society with specific moral, ethical, social and political codes of conduct. The Shariah allows each individual to form an ongoing relationship with God. Its laws provide the guidance humankind requires so that good will triumph over evil.
The Shariah covers two main areas, worship and worldly matters. In both, the scholars of Islam generally agree that mercy is its overriding principle. God says in the Quran that Prophet Muhammad, may the mercy and blessings of God be upon him, was not sent except as a mercy to humankind. (Quran 21:107) Prophet Muhammad reiterated this concept when he told his followers that “God shows mercy to those who have mercy on others. Show mercy to those on earth, and the One above the heaven will show mercy to you.”
The Shariah is derived from the primary sources of Islam, the Quran and the authentic Sunnah, or teachings, of Prophet Muhammad. The Quran gives us the main principles while the Sunnah provides the details of their application. For example, when the Quran tells us to establish the prayer, we must turn to the Sunnah in order to understand the details of how to pray. The Shariah also includes scholarly consensus, legal analogy and interpretive reasoning. This allows the Shariah to remain relevant in changing social and cultural circumstances.
The main objective of this course is to give the new student an appreciation, being able to detail key terminology chronology and bibliographic significance in the following topic areas: Mustalah-ul-Hadith Gensis of Isnad Ilm-ur-Rijaal Kutub as-Sunnah Al-Jarh wat-Ta’deel Fabrication & Fabricators
Fiqh which is derived from the hadeeth of the Prophet peace be upon him – or Fiqh of Hadeeth – may seem a little strange or even new for some of us; perhaps we have heard, studied or read about the various sciences of Islam: Usool Al-Hadeeth, Usool At-Tafseer, Usool AlFiqh, Usool Al – Aqeedah, etc. However, usually when one was to look at the books of Islamic knowledge, we find Fiqh as one subject and hadeeth or Sunnah as another subject. We have combined these two subjects in this course. Objectives of the course: Our aim is to familiarise the student with Hadeeth of the prophet peace be upon him. To teach the student different proofs and how to deduct laws from hadeeth. Our aim is also to show the student that he/she will find various Ahadeeth under one chapter and how they can practice on different Ahadeeth.
There has never been a human being so loved, well-respected and followed as Muhammad ?, the final messenger of Allah. There has never been a person who has changed world history so dramatically as Muhammad ? and his message. The Prophet ? was the single most important person in the history of the world. A journey through the life of the best of creation, the Prophet Muhammad ?. A look at his life, his struggles, his victories and how Islam was established. Beyond a shadow of doubt, the biography of Prophet Muhammad ? manifestedly represents an exhaustive embodiment of the sublime Divine Message that he communicated in order to deliver the human race from the swamp of darkness and polytheism to the paradise of light and monotheism. An image, authentic as well as comprehensive, of this Message is therefore only attainable through careful study and profound analysis of both backgrounds and issues of such a biography. MIU presents the first in a series of courses centering on the Seerah of our beloved Prophet (peace and blessings of Allaah be upon him). This course is unique in that it follows very diligently the seerah authenticated by the people of hadith, as Imaam Ash-Shaafi’ee said: “If I were to see a man from the people of hadeeth, it would be as if I have seen the Prophet (?) living.” [Sharaf As-haabil Hadeeth, 1/31]

Within Islam, there exists no complete set of commands and punishments that reads like a legal document. Muslims throughout history have endeavored to resolve societal, legal, political, and cultural problems by consulting the authoritative texts, the Qur’an and the sunna, as well as their own reason. Thus, Islamic law emerged, shaped and enhanced in this way by Muslim scholars, as a bulk of resources of revelation and a methodology for making rules. This Islamic jurisprudence literature (fiqh) is divided into two parts, the science of the methodology (usūl al- fiqh) and the science of the actual rules or legal field (furū al- fiqh). The methodology utilized for making rules is called usūl al-fiqh and it was developed in the classical Islamic period. The science of usūl al-fiqh is fairly thought to be the most significant research method organized by Muslim scholars. In this course, the book 'al-Waraqaat' by Imam al-Haramain al-Juwaini (رحمه الله) will be taught with an in-depth explanation. Explanations will be based on the works of Shaykh ibn 'Uthaymin, Shaykh 'Abdul Muhsin al-'Abbaad, Shaykh 'Abdullah al-Fawzan and others. Aims and objectives: Through this course, the student will gain an introduction to the science of Usool al-Fiqh, and a detailed understanding of the various Ahkam ash-Shar'iyyah (rulings of the Shariah), and more.
Bulugh al-Maram is the shortened name of the collection of hadith by al-Hafidh ibn Hajar al-Asqalani entitled, Bulugh al-Maram min Adillat al- Ahkam (translation: Attainment of the Objective According to Evidences of the Ordinances). It contains a total of 1358 hadiths., At the end of each hadith narrated in Bulugh al-Maram, al-Hafidh ibn Hajar mentions who collected that hadith originally. The Hadith are generally from Sahih al-Bukhari, Sahih Muslim, Sunan Abu Dawud, Jami at-Tirmidhi, 'Sunan al-Nasa'i, 'Sunan ibn Majah, Musnad Ahmad ibn Hanbal and other books of Hadith. Bulugh al-Maram holds a unique distinction in that all the hadith compiled in the book have been the sources for fiqh (Islamic Jurisprudence) rulings. Among the topic that this book covers are subjects ranging from marriage, business transactions to other more implicit aspect of the religion such as the five pillars. One more distinctive feature, along with others, is that the versions have also been shortened to present just the main purpose of the Hadith according to its classification under the chapter. Because of these preferential qualities, Bulugh Al-Maram has been accepted widely and is among the most sought-after books of Ahadith.
Imam al-Nawawi’s collection of 40 Hadiths is one of the most important collections of hadiths we have today. Imam al Nawawi actually compiled a total of 42 hadiths for this collection, not 40. He was one of the greatest scholars of Islam and lived from 631 A.H. to 676 A.H, passing away at the age of 45. Allah (swt) granted him blessing and success in his work so that he could make great contributions to Islam before passing away at a relatively young age. Imam al-Nawawi was a scholar in many different disciplines of Islamic studies. The vastness of his works in these different areas is so great that if an individual decides to study fiqh, hadith, spirituality, or Quran; one would need to pass through Imam al- Nawawi. Along with the 40 Hadiths, he authored Riyad al-Saliheen, Al-Adhkar, and commentary of Sahih Muslim and Sahih Bukhari. Imam al-Nawawi was one of the foremost figures of the Shafi’ madhab and the largest and most substantial book he wrote in this regard is called Al Majmua’ which is about 30 volumes. It is a work of comparative fiqh because he brings all of the opinions of different madhab’s on different issues together.

Tawheed in Arabic means attributing Oneness to Allaah and describing Him as being One and Unique, with no partner or peer in His Essence and Attributes. The Arabs say waahid, ahad and waheed, all meaning one. Allaah is Waahid, meaning that He has no rivals or peers in any way. So Tawheed means knowing Allaah is One, with none like unto Him. Whoever does not acknowledge Allaah in these terms and does not describe Him as being One with no partner or associate does not believe in Tawheed. With regard to the shar’i definition of Tawheed, it means believing in Allaah alone as God and Lord and attributing to Him alone all the attributes of Lordship and divinity. It may be defined as follows: Believing that Allaah is One with no partner or associate in His Lordship (ruboobiyyah), divinity (uloohiyyah) or names and attributes (al-asma’ wa’l-sifaat).
